Terms of service

Last updated 4 November 2026

These terms cover website work carried out by David Masomera, sole trader, Zimbabwe. They apply once you accept a quote or pay a deposit. Anything we agree in writing for your specific project takes precedence over what is written here.

The deposit and homepage designs

A 30% deposit starts your project. Within about 48 hours of receiving it, I send two homepage designs for you to choose from. The designs stay my property until the project is paid in full, are marked as design samples, and may be taken down if the project is cancelled. Placeholder photos and text in a design are illustrations, not a promise of the final content.

Quotes and prices

Payment

30% of the price to start, the rest when you are happy and before the site goes live on your domain. Payment is by EcoCash or bank transfer in USD. Third-party costs such as a domain name, paid hosting beyond the first year, stock photographs or a payment gateway are yours, and are quoted to you before anything is bought.

What I need from you

If a project goes quiet for more than 30 days after I have asked for something I need, I may close it and invoice for the work already done.

Changes and delivery

Each project includes two rounds of changes after the first draft. Further rounds, or changes that alter the agreed scope, are charged at an hourly rate agreed in advance. Timelines given are estimates in working days and depend on how quickly content and feedback come back.

Ownership

On full payment, the finished website, its content and its design become yours, and I hand over the files and the accounts. Until then the work remains mine. I keep the right to reuse the underlying code, techniques and components in other projects, and to show the finished site in my portfolio with your business name, unless you ask me in writing not to.

Domains, hosting and third-party services

Domain registration, hosting, Google Business Profile, WhatsApp Business and any payment provider are run by other companies under their own terms and prices. Where the quote includes a domain and hosting for the first year, renewal after that is yours to pay, either directly or through the care plan. I am not responsible for outages, price changes or account suspensions at those providers, but I will help you sort them out.

What is not promised

A website is built to be fast, findable and easy to use. Specific results — a position in Google, a number of enquiries, sales or bookings — depend on your market, your prices and your own promotion, and are not guaranteed. Search engines and social platforms change their rules without notice.

Cancellation

You may cancel at any time in writing. The deposit covers work already done and is not refunded once a project has started; anything paid beyond the value of the work done is returned. If I cannot complete a project, I refund what you have paid for work not delivered and hand over whatever has been produced.

Liability

My total liability for any project is limited to the amount you have paid me for it. I am not liable for indirect losses such as lost profit, lost data or lost business. Nothing here limits liability that cannot be limited by law.

Your obligations once live

Keep your own content lawful and accurate: prices, availability, claims about your services, and any personal information you collect from your customers. If your site collects customer details, you are the one responsible for them under the Cyber and Data Protection Act [Chapter 11:12].

Governing law

These terms are governed by the laws of Zimbabwe. We will try to settle any dispute by discussion first.
